THE PERVERSION OF ANTONIN SCALIA AND HOW HIS PERVERSION CHANGED DISCOURSE IN AMERICAN SOCIETY.by Martin S Friedlander on Tuesday, January 11, 2011 at 12:46pm. Few people realize how perverted geniuses can change society. Justice Scalia is one of those perverted geniuses. His interpretation of the Second Amendment was not "originalism". Travel back with me to 1789, the year of the great compromise. The 13 colonies had just signed the Treaty of Paris and they were working out a change from the Articles of Confederation to a Constitutional Republican form of Government. There were to be three branches. The Legislative, the Executive, and the Judiciary. The Legislative Branch was to be "Bicameral", which was a unique experiment. Each state would have two Senators no matter how small its size and population and there would be a House of Representatives based on population. The Northern States did not wish the Southern States to increase its population by importing Slaves and breeding the Slaves that lived in the South, so they counted a Slave to be 3/5ths of a person, for representative purposes only since Slaves and Indians would be granted no "Civil Rights". Then, in order to obtain 3/4 of the States to ratify the Constitution, the Framers drafted 10 Amendments which they called the "Bill of Rights". The Framers parsed their Constitutional words so that the meaning of each of those rights would require interpretation, and that included the Second Amendment. In 1789 the new colonial government did not have a standing army, nor did they want one. A Standing Army would give control to its Commanding General. Then a Standing Army would have to be paid as "full time" soldiers, and be "quartered". The Framers decided that a fair compromise would be that each free man would be a member of the reserve army, as the Militia was called in those days. Remember the "Minute Men" who fought the English at the battles of Lexington and Concord. These colonist had rifles and muskets for defense against the Indians and to hunt animals for food, and if necessary these Colonists could be called together with their muskets which they kept in their homes to form a small militia for a collective defense. Muskets stored at home were an essential ingredient for this collective defense that could be raised in a "minute". No matter what Scalia says, the prefatory language regarding a Militia, was understood and well defined. The purpose of the right to bear arms was to legitimize a "minute man" militia, plus the ability to defend against marauding Indians and to hunt wild animals to live. There was to be "no absolute right to bear arms", except for a specific purpose. We were a frontier country in 1789, not a modern military force that was required to fight two world wars. In 1789 we had few police. Now we have thousands of Police. Then we had no "organized" militia. Today we have National Guard units commanded by the State Governors, and the Army Reserve commanded by the President. The need for a "Swiss" militia had disappeared with time. The need for individual self defense had disappeared with time. The need to hunt for food had disappeared with time; and the need for "Minute Men" had disappeared with time. LIKEWISE THE NEED FOR AN ABSOLUTE RIGHT TO BEAR ARMS, DISAPPEARED WITH TIME. WE NO LONGER LIVE IN 1789. WE LIVE IN THE NUCLEAR AGE WHERE MILLIONS CAN BE KILLED WITH A SINGLE BLAST. IS THERE ANYONE IN THIS COUNTRY, INCLUDING SCALIA THE GENIUS, WOULD DECLARE AN ABSOLUTE RIGHT TO BEAR A NUCLEAR WEAPON, ESPECIALLY WHEN A HOME GROWN DEVICE CAN BE THE SIZE OF A BRIEF CASE. THE SECOND AMENDMENT AS CONSTRUED BY SCALIA THE GENIUS SHOULD DISAPPEAR AS DID CARTHAGE AND THE ROMAN EMPIRE. IT IS NO LONGER NEEDED. SCALIA, THE EVIL GENIUS, WITH ALL HIS BLUSTER, SHOULD ALSO DISAPPEAR AS HE IS NO LONGER NEEDED. We all have access to the Federalist Papers with the education to read and interpret them for ourselves. Scalia should disappear as did the last "ice age".
